How to Buy Property in Pakistan From Canada (2026)

The country-specific route, checked against Canada’s own Pakistan mission on 3 September 2026: the power of attorney, the banking channel, the filer-rate tax, and the hours we can actually talk.

Short answer: Ottawa attests your signature only, not the contents of the POA. Photos under three months old, Global Affairs first, and the 1.25% filer rate explained.

Yes — with a NICOP or POC you buy property in Pakistan from Canada on the same terms as a resident citizen, and you pay the filer rate of 1.25% advance tax on purchase under clause (111AC) rather than the 10.5–18.5% a non-filer pays. The Canadian specifics are all about the paperwork chain: the High Commission in Ottawa requires you to attend in person and sign in front of an official, wants photographs taken within the last three months, and — the sentence worth reading twice — states that it attests your signature only, and takes no responsibility for the contents of the power of attorney. Canadian-issued documents have to go through Global Affairs Canada first. Everything below was checked against the High Commission’s own page on 3 September 2026.

Power of attorney for Pakistan from Canada

Source, checked 3 September 2026: mofa.gov.pk/ottawa-attestation, the High Commission of Pakistan, Ottawa. Its requirements for executing a power of attorney:

  • The executant must attend personally and sign the POA in front of the concerned official.
  • Original documents plus an additional set of photocopies.
  • Original valid Pakistani ID — passport or CNIC/NICOP — plus photocopies.
  • A copy of the CNIC/NICOP/POC of the person receiving the authority.
  • Two passport-size colour photographs, white background, taken within the last three months.

The most useful sentence in this entire cluster, and it is Ottawa’s own: “The High Commission of Pakistan only attests signature(s) of the executants and does not take any responsibility for the contents or authenticity of the contents of the Power of Attorney.” Read that as the operating instruction it is. An attested POA is not a vetted POA. The stamp says “this person signed it”, not “this document is safe”. A general POA drafted by a dealer is still a general POA drafted by a dealer after the High Commission has stamped it. The protection is in the drafting — one named plot, one named attorney, no power to sell or mortgage, revocation after transfer — and that is what the power-of-attorney guide is for.

Two more Canadian details. Documents issued in Canada must first be attested by Global Affairs Canada; documents issued in Pakistan must first be attested by the Ministry of Foreign Affairs in Islamabad or a camp office. And the High Commission points readers to Pakistan’s apostille facility at apostille.mofa.gov.pk (live, checked 3 Sep 2026) — worth knowing exists, though a POA for a Pakistani land transfer runs down the consular route, not the apostille one.

For the remote route, NADRA lists four Canadian missions — Ottawa, Toronto, Vancouver and Montreal. Choosing the wrong mission is a published cause of rejection, and the online fee is not refunded when an application is rejected.

How the money legally moves from Canada to Pakistan

A Roshan Digital Account opens remotely from Canada with the major Pakistani banks and is the channel that keeps your options open: principal repatriable at any time, capital gain repatriable three years after the investment, per SBP’s RDA rules. A normal declared remittance to your own Pakistani account is equally legal — but SBP’s RDA FAQ says proceeds from a property that was not bought through an RDA cannot later be put into one, so a Canadian buyer who may want funds back in CAD one day should decide that on the way in, not on the way out.

Section 75A of the Ordinance requires immovable-property payments above PKR 5 million to move through banking or digital channels. The repatriation doors, honestly and what an RDA does and does not finance are the two follow-ups most Canadian readers need.

What a buyer from Canada actually pays in tax

One clause decides this, and most people quoting you rates have never read it. Clause (111AC) of Part IV of the Second Schedule to the Income Tax Ordinance, 2001 switches off section 100BA and rule 1 of the Tenth Schedule for a non-resident holding a POC or NICOP on transactions taxed under sections 236C and 236K. In plain English: on a property purchase or sale you are charged the filer rate even if you have never been on the FBR active taxpayer list.

After the Finance Act 2026 that means 1.25% of fair market value as the buyer (§236K) and 2.75% of gross consideration as the seller (§236C), both flat. The non-filer alternative on a purchase runs 10.5% up to PKR 50 million, 14.5% between 50 and 100 million and 18.5% above that — so on a PKR 2.14 crore plot the clause is worth roughly PKR 1.98 million. Add roughly 1% ICT stamp duty and the society transfer fee. The full picture, traced to the gazette, is in are overseas Pakistanis exempt from property tax, and the landed cost of a specific plot is in the cost calculator.

Time zones — when we actually talk

Pakistan is 9–10 hours ahead of Toronto and Montreal, and 12–13 ahead of Vancouver. The overlap that works is our early morning against your evening — which is when video plot walks are scheduled for Canadian clients as standard. Between those windows, everything runs on WhatsApp.

The seven steps

1

Documents ready

NICOP (or POC) is your key. If it has expired, renew online at NADRA first — every later step checks it.

2

Open the banking channel

A Roshan Digital Account opens fully remotely with a major Pakistani bank in days. It keeps your money documented and repatriable — and unlocks Roshan Apna Ghar property products.

3

Send the brief

Budget, size, project, horizon. You get a written shortlist: sector, asking price, possession status, and each plot's honest drawback.

4

Video plot visit

Live WhatsApp video from the plot — the street, the neighbours' construction, the road level, the walk to commercial. Recorded so you can rewatch.

5

Power of attorney

Executed at your embassy/consulate or — the modern route — online via NADRA at poa.nadra.gov.pk, then MOFA-verified in Pakistan. Your attorney signs only what the POA names.

6

Payment & taxes done right

Funds move through your RDA. As a non-resident NICOP holder you claim filer tax rates under Clause 111AC (1.25% §236K instead of up to 18.5%) — we prepare this before transfer day.

7

Transfer, witnessed

NDC obtained, transfer executed at the society office under our supervision, documents couriered and scanned to you same day.

Yes, end to end, provided you hold a NICOP or POC. The purchase runs on three rails: your NICOP, a documented banking channel (a Roshan Digital Account opens remotely), and a special power of attorney naming one plot and one attorney. Verification, negotiation and the transfer itself happen through this desk with video where your eyes need to be. The buyers who get burned are the ones who skip verification — not the ones who stay abroad.

Execute a Special Power of Attorney and attest it at the Pakistan High Commission Ottawa or the Consulates General in Toronto, Vancouver or Montreal — or skip the consulate queue entirely with NADRA's online POA service at poa.nadra.gov.pk. MOFA verification in Pakistan completes it before any society office accepts the document.

Open a Roshan Digital Account with a major Pakistani bank from Canada (HBL, UBL, Meezan, Bank Alfalah onboard you fully remotely) and remit through it — a clean banking trail, repatriable by SBP design, and it qualifies you for Roshan Apna Ghar property products.

Pakistan is 9–10 hours ahead of Eastern Canada (Toronto/Montreal) and 12–13 ahead of Vancouver. Our early-morning PKT desk is your evening — video plot visits are scheduled to Canadian evenings as standard.

As a non-resident NICOP/POC holder you qualify for filer rates under Clause 111AC: 1.25% advance tax (§236K) on the FBR value, instead of the 10.5–18.5% non-filers pay — plus roughly 1% ICT stamp duty and the society transfer fee. The relief is applied for through the FBR portal before the transaction; we prepare it as standard for every overseas client.

No. A NICOP/POC holder has full, unrestricted property rights in Pakistan — identical to a resident citizen. The BOI-approval and interior-ministry-NOC regime you may have read about applies only to actual foreign nationals with no Pakistani-origin card. Your NICOP is the only status document this purchase needs.

NICOP/POC hai to resident ki tarah. Teen cheezein: NICOP, documented banking channel (RDA Canada se remotely khul jata hai), aur ek special POA. Plot pehle verify hota hai, POA baad mein banta hai jo usi plot ka naam le. Tax: kharid par 1.25% filer rate clause (111AC) ki wajah se.

High Commission ki apni page (3 Sep 2026) ke mutabiq: executant ko khud jaana parta hai aur officer ke saamne sign karna hota hai; original + photocopies; valid Pakistani passport ya CNIC/NICOP; attorney ki CNIC/NICOP/POC copy; aur do colour photos, white background, jo teen maheene se purani na hon. Canada ke documents pehle Global Affairs Canada se attest hone chahiye.

Nahi — aur ye High Commission khud likhta hai: wo sirf signature attest karta hai, POA ke mazmoon (contents) ki zimmedari nahi leta. Yaani ghalat likha hua general POA stamp lagne ke baad bhi ghalat hi rehta hai. Hifazat drafting mein hai: ek plot ka naam, ek attorney, bechne/mortgage ka ikhtiyar nahi, aur transfer ke baad tehreeri revocation.
