Everyone searches 'Property Act 2025' — there are actually two: a federal 2024 Act whose special court covers Islamabad Capital Territory, and Punjab's 2025 Act for its 37 districts. Which one protects your plot, and how to use it from abroad.

Here is what every page ranking for “Overseas Pakistanis Property Act 2025” gets wrong: there is no single act by that name. There are two separate, real laws, passed a few months apart at two different levels of government — and which one protects your plot depends entirely on where the plot is. If your property is in Islamabad — Bahria Enclave, DHA Margalla Enclave, any ICT sector — the law that covers you is the federal Act of 2024, not the Punjab Act of 2025 that most search results describe. We verified both from the official law repositories and assembly records; here is the whole picture, dated.

If your plot is in Islamabad: the federal special court, and it is running

The federal Act gives its special court jurisdiction “over the entire Islamabad Capital Territory” — the ministry’s own announcement and independent press coverage both carry that phrase. And this is not a paper court: 2026 reporting describes the machinery constituted and operating — the Islamabad High Court set up a special bench (headed by Justice Khadim Hussain Soomro), and two District & Sessions Judges were designated for Islamabad East and Islamabad West. For a Bahria Enclave or Margalla Enclave owner, that is the door.

Three design features matter to someone sitting in Manchester or Toronto:

  • E-filing — the case can be lodged without travelling to Pakistan.
  • Video-link evidence, supervised by your Pakistani mission — testimony is taken with the High Commission / consulate’s supervision, so “come to Pakistan for every hearing” stops being the weapon it used to be.
  • A 90-day disposal target — the statute’s stated timeline for deciding the case. Treat it as the design goal, not a measured track record: as of August 2026 no public data exists on whether the courts are actually hitting it, and we won’t pretend otherwise.

The Punjab Act 2025 — the one everybody searches for

Punjab’s version is the newer law and the one that dominates search results — which is exactly why overseas owners of Islamabad plots keep reading the wrong statute. Passed by the Punjab Assembly on 20 January 2025, it stands up special courts in all 37 Punjab districts, staffed by designated District & Additional Sessions Judges, with the same overseas-friendly mechanics. (Reports place the Governor’s assent and gazette publication at 29 January 2025 — we could not open the Punjab gazette itself to certify that exact date, so we publish it as reported, not confirmed.)

One genuinely important development came later: some Punjab special courts initially read their jurisdiction narrowly — taking possession and qabza cases but bouncing inheritance, specific-performance, cancellation and power-of-attorney disputes back to the ordinary civil courts, which would have gutted the law’s point. In a ruling reported 7 May 2026, the Lahore High Court (Justice Anwaar Hussain) shut that down: the special courts have jurisdiction over “all matters having nexus with such immovable property” whenever an overseas Pakistani is a party — plaintiff or defendant. If a lawyer or opposing party tells you your inheritance or POA dispute “doesn’t qualify”, that ruling is the answer.

What these courts actually hear

The target list is the classic overseas-Pakistani nightmare file: illegal possession (qabza), fraudulent transfers executed while you were abroad, and — after the LHC ruling — the full ring of disputes connected to the property: inheritance shares, cancellation of forged instruments, specific performance, POA abuse. If you are reading this before a purchase rather than after a fraud, take the cheaper lesson: every one of these cases begins with a verification step someone skipped. What we could not verify — and therefore will not claim. (1) The statutes’ exact definition of “overseas Pakistani” — whether NICOP/POC is the formal eligibility test — because neither official repository would serve the full operative text; we publish the mechanics that are multiply-sourced and leave the definition to your lawyer. (2) Any case-count or success-rate data for either court system — none has been published. (3) The exact federal assent date beyond “late October 2024”. Pages asserting these things confidently are guessing.

If you want the text, go there directly. A cottage industry of dealer pages now offers “Overseas Pakistani Property Act 2025 PDF download” — some are fine scans, some are summaries dressed as statute, and at least a few confuse the federal and Punjab laws in the very first paragraph. Read the source, not the reseller.

Complaints without litigation

Not every problem needs a courtroom. The Overseas Pakistanis Foundation runs a free complaint channel — [email protected], the OPF online complaint system (opf.pitb.gov.pk), the Pakistan Citizen’s Portal, or any Pakistani mission abroad. For dues disputes, transfer-office stonewalling and records issues, that route costs nothing and creates a paper trail a later case can use.

The honest bottom line for an Islamabad owner

You now have something overseas owners did not have three years ago: a dedicated court for your plot, in the territory your plot actually sits in, designed so you can pursue it from abroad. It is real, it is constituted, and it is new enough that nobody can honestly tell you how fast it runs. Use it if you must — but the better use of this page is upstream: sell properly through a verified process, buy through verification, and structure your POA so there is never a dispute to file.
